Bruce Ratner had hoped New York's second highest court would hear a critics' appeal of a key lower court ruling this spring. The critics wanted it heard next year. The state Appellate Court has now scheduled its hearing on the appeal for September. The critics' continuing appeals could jeopardize the arena's planned 2010 opening.
