Critics of the Nets' Brooklyn arena suffered their latest--and most damaging--defeat Friday when the US Circuit Court of Appeals rejected their challenge to New York State's plans to condemn private property for Bruce Ratner's Atlantic Yards. Critics had argued that the Nets' arena did not constitute a "public purpose" and thus should not benefit from eminent domain. The critics have not won a single case or appeal.
