In what could be their last major battle to halt Bruce Ratner's Atlantic Yards project, critics argued to an appeals court that the Nets' new home was not a public use and thus New York State has no right to evict the remaining homes and businesses. The state disagreed and reporters at the hearing wrote that Appeals Court judges' questions seemed to suggest the critics have a "high hurdle to clear".
