A New York State Appeals Court has upheld the dismissal of a critics' lawsuit, the latest setback for those opposed to Bruce Ratner's Atlantic Yards, the $4+ billion project anchored by the Nets' new arena. The critics had claimed tenants in some of the buildings already owned by Ratner had rights in eminent domain proceedings. A lower court had dismissed the case in May. Meanwhile, Ratner is picking up the pace of site preparation.
