Arena Critics Lose Again...and Again
Barclays Center construction continues apace with Bruce Ratner telling friends it's on schedule for completion in late spring/early summer 2012. At the same time, the same Brooklyn judge who pushed Daniel Goldstein to sell out back in April dismissed two of the last challenges to the arena on Monday
One of the dismissals was the last challenge to eminent domain. The other was a well-publicized but failed bid to get more money from the state for air rights above one of the buildings seized for the project.
Judge Abraham Gerges dismissed the critics argument that the Atlantic Yards development plans had so changed new approvals were necessary. The judge ruled the changes "do not change the public purpose to be served by the Project." Critics are now left with one final challenge, a request that another judge rehear arguments on the same issue. It's considered a long-shot.

It would be very offensive
To many of my friends in the justice system to continue to claim these judges, who have worked entire careers of service to be put in that position, are corrupt.
It’s really disgusting that you continue to believe anyone opposed to your viewpoint is a corrupt, pocket lining, reptile who will do anything to satisfy Ratner.
You have got to get these conspiracy theories out of your head. Seriously, it just can’t be good for you.

by the way Bruce Ratner has friends? Find that hard to believe other than people he has paid off for the last six years.
Friends in high places strikes again
Once again, Ratner wins because of friends in high places. Do you think he could this far if he didn’t have the ESDC backing him? He probably would not. I once heard that the judge that gave the green light to have the new Yankee Stadium built got VIP seats to a game there, so I wouldn’t be surprised if the same will go for Gerges for his ruling. It just shows that all you need is friends in high places, and you can get anything you want whenever you want without ever feeling hindered by it. If this was through ULURP, I can tell you that it wouldn’t even be off the ground, which is why it went through SEQRA instead so that he can side step a lot of the process.

I want you to realize you are on a fool’s errand…that your silly recitation of how things should have worked, filled with jargon and acronyms, is meaningless at this point…meaningless.
There is a fundamental lie at work in all these challenges. First, you attempt to slow the project in hopes that it will get so expensive it will die. Then, when changes have to be made because of time and money lost because of your litigation, you claim that the required changes should require new approvals. Then, you claim that the the process is corrupt. The legal challenges are attempts to corrupt the legal system and in each and every case, judges have thrown out those challenges. The number of judges who have decided against the critics, on the federal and state level, is greater than 20…and includes all but one member of the state’s highest court and the Supreme Court. All the judges who have decided these cases are corrupt?
It is Hypocrisy which needs no acronym to describe it.

Nice to hear someone tell it like it is around here for a change. As for you Net Income, your insults are sad as it becomes more and more clear how miserbale of an individual you reallyare. You just can’t stand the fact that people actually disagree with you and want the Nets to remain in New Jersey which is so clearly against the wishes of those you worship (since I am not allowed to imply you actually work for anyone right?)

Please explain why do people have to give up their property to a private developer even if they choose not to especially if they are forced to by the government. Making fun of the two kinds of process really shows how little you know about the system. Just because the ruling was made doesn’t mean that they were right about it. Keep in mind that I did mention US Supreme Court cases where the rulings were wrong and were justified thanks to biased judges. When you try to use the blanket statement of “They already made their decision, and there is nothing you can do about it”, you sound like someone who supports these backroom deals, because they are the only ones who I have seen to make that kind of claim. Don’t try to hide behind that. The only reason why it wasn’t done through ULURP was because local politicians would have much more of a say, and the MAS finds it a bad idea to place a project like this in a dense, urban area where it’s planned, so it had to go through SEQRA instead in order to bypass all of it. The only corrupt thing here is allowing for a private developer to use a process that was meant for public projects only.
